Usually, yes. A facility can be held responsible for what its employees do on the job, and separately for its own failures, such as hiring someone it should have screened out, understaffing a unit or ignoring earlier complaints. Whether a particular case is viable depends on the facts, the state and how quickly it is filed. ### Is it legal for a facility to restrain or seclude a patient? Only in narrow circumstances. Federal rules for hospitals and youth residential programs that take Medicare or Medicaid allow restraint or seclusion only to keep a patient or others physically safe, never as punishment or for staff convenience, and they require an order, monitoring and documentation. Restraint used outside those limits can support a civil claim. ### Does an involuntary commitment mean I cannot sue? No. People held involuntarily keep their right to be free from abuse, and in a state-run facility a person in custody may have constitutional claims as well as ordinary injury claims. Claims against public hospitals often carry short notice deadlines, so timing matters. ### Who can I report abuse at a mental health facility to? You can report to police, to the state agency that licenses the facility, and to your state's Protection and Advocacy organization, which has federal authority to investigate abuse of people with mental illness in facilities. For a child, the state child abuse hotline is also an option. ### How long do I have to file a lawsuit? It depends on the state, the type of claim and whether the patient was a minor. Many states give child sexual abuse survivors extra time, and some have opened revival windows, while claims against government-run facilities can require written notice within months. A lawyer licensed in your state should confirm the deadline. ## Latest releases _Press releases are sponsored content issued by the organizations named._ - [Survivors of Abuse NJ Announces Recognition of Joseph L.
